ACCEPTANCE AND GENERAL CONDITIONS

These general conditions of sale govern the purchase of goods and services made remotely via the Internet on the website www.mareventofavignana.it owned by Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy, with (Operational Headquarters: Via dei Gladioli, SNC, 91100 Trapani TP – At: Vento di Maestrale Marina – Porto Turistico), and ( Registered Office: Via Calypso, 38, 91100 Trapani TP), VAT number 02918660818; Chamber of Commerce Registration R.E.A. TP-206301).

• a. Submitting an order through the website www.mareventofavignana.it, by email or by phone constitutes conclusion of the sales contract and full acceptance of these conditions without any exceptions. The contract between Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy and the Customer is considered concluded upon acceptance, even partial, of the order by Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy. By placing an order as described, the Customer declares that they have read all the information provided during the purchase process and fully accept these general conditions of sale.
• b. Once the purchase process is complete, the Customer must print or save an electronic copy and keep these general conditions of sale, in compliance with the Consumer Code Legislative Decree 205/2006 as amended by Legislative Decree 21/2014 on distance sales.
• c. Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy is not liable for any damage or loss, direct and/or indirect, resulting from the sale of goods and services offered on the site www.mareventofavignana.it, including delayed and/or failed delivery of the service or goods, nor for the correspondence of the goods or services with the specifications published on the site, nor for any other fact not directly attributable to Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy. Any right of the Customer to compensation or indemnity is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or property caused by failure to accept or fulfill, even partially, an order.

Art.1 Booking Confirmation

The booking will be considered confirmed upon signing this contract.

Art.2 Payment of the Rental Price

Full payment or the balance if a deposit has been paid must be made before the rental or boarding.

Art.3 Navigation Area

The renter undertakes to limit the navigation of the boat to the specified Navigation Area, in compliance with local laws.

Art.4 Authority of the Skipper

The skipper will provide the renter with attention and respect. He will follow the renter’s orders as long as they are reasonable and comply with navigation safety. The skipper is not required to follow orders that could jeopardize safety or compromise the timely delivery of the boat.

Art.5 Navigation Safety

The skipper is authorized to ask anyone behaving dangerously to leave the vessel. Passengers must present themselves for boarding 30 minutes before departure. Delays will not entitle refunds. The staff will provide all necessary information in case of doubts. The owner may change programs and schedules for weather reasons, force majeure or technical requirements, without entitlement to refunds for customers. Swimming and circumnavigations depend on weather and sea conditions and are at the captain’s discretion. In case of cancellation due to force majeure, no refund is due.

It is strictly forbidden on board to:

• Behave or act in a way that may disturb or harass other passengers.
• Tamper with furniture and equipment on board.
• Wear or carry weapons and ammunition in luggage.
• Carry glass objects, flammable, explosive, corrosive or otherwise dangerous materials in baggage, as well as cylinders filled with oxygen, compressed air, gas, and similar.
• Transport letters and parcels subject to postage fees.
• Throw any objects into the sea.

Art.6 Renter’s Cancellation

If the renter cancels the booking, the deposit paid will be refunded as follows:

• The booking is confirmed with 100% payment or a 30% deposit. The 70% balance must be paid before the tour starts.
• We guarantee free cancellation and full refund if the cancellation is made within seven days prior to the excursion date, regardless of the reason. It is possible to change the excursion date, subject to availability.
• If you cancel the booking between seven days and 24 hours before the scheduled start time, you will be entitled to a 50% refund of the amount paid.
• If you cancel the booking less than 24 hours before the scheduled start time or fail to show up for the excursion, even due to involuntary delays, you will not be eligible for any refund. In this case, you will lose the entire amount paid for the excursion.
• In case of bad weather or equipment problems, if the excursion cannot take place, the ticket will be fully refunded or, alternatively, may be moved to another day based on customer and equipment availability. Passenger safety and well-being are our priority.

Art.7 Owner’s Cancellation

For reasons of force majeure or unpredictable and unavoidable personal reasons, the owner may cancel the contract. An alternative will be offered or the deposit will be refunded without further compensation claims.

Art.8 Owner’s Obligations

The owner will ensure that the boat is in perfect condition, complete with safety equipment, and complies with current regulations. The owner declares that all legal insurances have been subscribed.

Art.9 Renter’s Responsibilities

The renter must care for the boat diligently. In case of breakdown or damage attributable to their conduct, they must compensate the owner for repairs. The renter is not responsible for damage caused by adverse weather and sea conditions.

Art.10 Unexpected Breakdowns or Damages

In case of unexpected breakdowns, the owner undertakes to repair the boat as soon as possible. No compensation can be requested.

Art.11 Cruise Features and Conditions

The owner declares to have been informed about the boat’s features and cruise conditions, including the maximum number of people allowed on board.

Art.12 Personal Data Protection

Pursuant to Art.13 of Regulation (EU) No. 2016/679, the personal data provided will be processed for contractual and service purposes, ensuring security and confidentiality.

Art.13 Complaints

Any deficiencies or irregularities in the service can be reported to the Captain on board or by writing to: [email protected].

Art.14 Jurisdiction

For any dispute arising from this contract, the first instance will be a mediator chosen by Mare e Vento di Favignana – Escursioni Tour in Barca Egadi – Favignana e Levanzo di Biolla Noemy and thereafter the Court of Trapani.

Art.15 Applicable Law

For all matters not covered by this contract, reference is made to the provisions of the navigation code, the civil code and applicable Italian laws.
